1. Acceptance of Terms
By accessing or using Scoopy ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Scoopy provides foreclosure data intelligence across multiple Texas counties. The Service includes property data, map visualizations, analytics dashboards, and related tools available through a paid subscription.
3. Subscription & Payment
Access to the Service requires an active subscription. Subscription fees are billed as agreed upon between you and Scoopy. Access may be revoked for non-payment.
4. Acceptable Use
You agree not to:
- Share your login credentials with others
- Scrape, crawl, or bulk-download data from the Service
- Redistribute, resell, or republish data obtained from the Service
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
5. Data Accuracy & Disclaimer
Scoopy provides data sourced from public county records and third-party services. We do not guarantee that any information provided through the Service is accurate, complete, current, or error-free.
Specific limitations include but are not limited to:
- Property values are automated estimates derived from third-party data, not professional appraisals.
- Sale dates may be postponed, cancelled, or rescheduled by the county or trustee without notice to us.
- Property addresses are extracted from county filings and may occasionally be mismatched, incomplete, or formatted inconsistently.
- Ownership records, mailing addresses, and legal descriptions may contain errors, be outdated, or differ from current county records.
- Phone numbers and email addresses obtained through skip tracing are sourced from third-party databases and may be inaccurate, disconnected, or belong to a different individual.
- Repost and related notice detection is based on automated address matching and may produce false positives or miss valid matches.
- Equity estimates are calculated from estimated values and recorded loan amounts, neither of which may reflect current reality.
All data is provided for informational purposes only. You must independently verify all information before making any investment, purchasing, legal, or financial decisions. Scoopy is not responsible for any losses, damages, or decisions made based on data provided through the Service.
6. Not Legal, Financial, or Real Estate Advice
The Service does not provide legal, financial, tax, or real estate advice. Nothing in the Service constitutes a recommendation to buy, sell, bid on, or invest in any property. You should consult qualified professionals (attorneys, appraisers, financial advisors) before acting on any information obtained through the Service.
7. No Refund Policy
All subscription payments are final and non-refundable. By subscribing to the Service, you acknowledge and agree that no refunds will be issued for any reason, including but not limited to: partial-month usage, dissatisfaction with the Service, data inaccuracies, or failure to cancel before a billing cycle renews. You may cancel your subscription at any time to prevent future charges, but no refund will be provided for the current billing period.
8. Intellectual Property
The Service, its design, features, and original content are owned by Scoopy. You may not copy, modify, or create derivative works based on the Service without written permission.
9. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, Scoopy and its owners, operators, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Service, including but not limited to: financial losses from investment or purchasing decisions, missed auction dates, incorrect property data, reliance on estimated values or equity calculations, failed skip trace lookups, or any other use of information obtained through the Service.
Your total aggregate liability under these terms shall not exceed the amount you paid for the Service in the one (1) month immediately preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Scoopy and its owners, operators, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) any actions you take based on data provided by the Service; or (d) your violation of any third party's rights.
11. Termination
We may suspend or terminate your access at any time for violation of these terms or for any other reason at our discretion. You may cancel your subscription at any time to prevent future billing, but no refund will be issued for the remaining period.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Bexar County, Texas.
13. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
